Classification and Inmate Records

 

Classification

The primary function of inmate classification is the systematic process of coordinating evidenced based inmate assessments and assignment procedures with available resources so as to minimize community risk. An inmate at any custody level can be assigned to any facility that has a security level at or above the inmate’s custody classification. The Department will attempt to provide opportunities for the productivity, growth, and development of the inmate in the least restrictive setting possible. The classification process will utilize all available information, but will endeavor insofar as practicable to base all decisions on a standard list of established case factors with each identified factor being given the same relative consideration for each decision. Program access, work assignments, and administrative decisions will be made without regard to an inmate’s race, religion, national origin, sex, disability, or political views.

Inmate Records

Upon admission to the Nebraska Department of Correctional Services, the Records Office of the receiving facility (Diagnostic & Evaluation Center or the Nebraska Correctional Center for Women) creates an "institution" inmate file. This file is maintained on active status throughout the entire period of incarceration. Upon discharge, the file is transferred to the Central Records Office for permanent storage and microfilming in compliance with the Department's Records Retention Schedule.

Per Nebraska Revised Statute 83-178, the contents of the inmate file are confidential and cannot be released without a court order. However, limited information is a matter of public record and may be released to the public upon request. Along with the "institution" inmate file, a Central Office inmate file is also created in accordance with Nebraska Revised Statute 83-1,100. This file is similar to the "institution" file maintained by the institution Records Office and is also confidential in accordance with the Statutes cited herein. The Board of Parole and its staff use this file to assist in carrying out the duties of that agency. The Central Office departmental staff also uses this file to assist them in the routine decision making functions of those positions.
